Why HOA management in Curaçao

HOAs are regularly a source of annoyance and discussion for the members who are part of them. The members all live together in a building or resort and must reach agreement with each other on important topics. So many people, so many wishes. In addition to members who are also residents in the building or resort, there are also members who allow their apartment to be used by, for example, a tenant. Additionally, it also occurs that, alongside residences, commercial spaces are present in a building or resort, such as hospitality venues, shops or business space. Due to all these differences within one building or resort, different interests can arise. These different interests can lead to a great deal of discussion between members and residents.

Rules within the HOA

Precisely because an HOA is an association of which members are obliged – and therefore not voluntarily – members, simply because they live in the same building, it is of great importance that everyone is aware of the rules within the HOA. Only in this way can members show understanding for each other and jointly take important decisions in a proper manner regarding the management of the building. This applies to technical, administrative and financial management.

Professional HOA manager in Curaçao

Because most HOAs are dependent on a volunteer board, it has become common practice in the Netherlands to appoint a professional HOA manager. Meet VvE Beheer Curaçao. The first and only professional HOA manager on the island. It occurs that project developers, real estate agents, or insurance intermediaries in Curaçao manage HOAs, but that is not their primary goal; it is not their core business. VvE Beheer Curaçao believes that managing HOAs is a specialty that requires specific knowledge. Precisely by applying and sharing this knowledge with HOAs, many conflicts and legal proceedings can be prevented.   • Who executes the decisions of the HOA?

    Legally, a board is appointed by the members. The board ensures the implementation of the decisions of the owners’ meeting. The owners’ meeting can appoint an external, professional HOA manager to relieve the board of the burden of executing all decisions.

  • Who determines all matters within the HOA?

    The owners’ meeting is the highest governing body of the HOA. All decisions concerning the management of the common property are taken within this meeting. All apartment owners have access to the owners’ meeting. Decisions are adopted by an absolute majority of the votes cast.

  • When can major maintenance be carried out?

    After a legally valid decision by the owners’ meeting and approved budget, orders can be issued for major maintenance. See the article “Major Maintenance within your HOA” for this.

  • What can I do if I disagree with an HOA decision?

    When an apartment owner is of the opinion that a decision by an organ of the Homeowners Association unreasonably affects their interests due to its content or manner of coming about, they can request the court of first instance to annul a decision within one month after they were able to take notice of the decision (Book 5 Civil Code: art. 130).

  • What does my advance contribution consist of?

    The owners’ meeting annually establishes a budget listing all costs that the HOA must pay for the HOAs operations. In the deed of division, an owner can find the allocation key of their apartment right. This allocation key is applied to distribute the total budget across all apartment rights.
